Refunds:
50% refund for cancellation between 48 hours and 24 hours before pickup and no refund for cancellation within 24 hours of pickup. If Wanaka Transport Group Ltd (yello!) cancels the activity due to, road, weather conditions, or other cause (refer to Terms and Conditions that follow) then a full refund less any unrecoverable costs will be made.
Refunds are granted solely at the discretion of Wanaka Transport Group Ltd according to the Terms and Conditions which follow. Where a refund is granted, it will be subject to reasonable administration and cancellation costs. Where a booking has been made via an Agent, refunds may only be obtained from the Booking Agent. Note that the Booking System provider’s transaction fees are not refundable.
General:
Both Wanaka Transport Group Ltd, trading as yello! and any Agent (including their respective employees, agents, officers and directors) exclude, to the fullest extent possible under law, all and any liability for any loss, damage or injury (whether direct or indirect or consequential, however arising) suffered by you or any person associated with you in relation to the booked service. To the extent permitted by applicable laws, all warranties, representations and implied terms are also excluded. Wanaka Transport Group Ltd reserves all rights to cancel any service at its discretion for (but not limited to) any of the following reasons: a), road or weather conditions; b) lack of numbers using the service; c) unsuitability of you, or anyone associated with you, due to reasons such as age, ill health, intoxication or any other reasons rendering you, or anyone associated with you, unsuitable or unfit to use the service; d) any other circumstances which are beyond the reasonable control of Wanaka Transport Group Ltd.. All Guests agree to adhere to any instructions in relation to the service from Wanaka Transport Group Ltd at all times
Force Majeure:
Except where otherwise expressly stated in these Booking Conditions Wanaka Transport Group Ltd will not be liable or pay you compensation if our contractual obligations to you are affected by “Force Majeure”. For the purposes of these Conditions, Force Majeure means any event beyond our or our supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination, the act of any government or other national or local authority including port or river authorities, industrial dispute, labour strikes,natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transport and all similar events outside our or the supplier(s) concerned’s control.
